APPLICANT CONTENDS THAT: 

 

His attendance at the United States Air Force Academy 
Preparatory School should have adjusted his TIS and TIG.

STATEMENT OF FACTS: 

 

The relevant facts pertaining to this application are contained 
in the letter prepared by the appropriate office of the Air 
Force. Accordingly, there is no need to recite these facts in 
this Record of Proceedings.

THE AIR FORCE EVALUATION: 

 

AFPC/DPSIPE recommends denial. DPSIPE states that the applicant 
enlisted in the Air Force Reserve on 16 Jul 2008 for a one-year 
period. During the one-year enlistment, he served a total of 
5 months and 24 days of active duty before separating on 8 Jan 
2009. On 18 Oct 2011, he enlisted into the Regular Air Force 
through the Air Force Recruiting Service for a period of 4 years 
as a non-prior service (NPS) applicant. He did not meet the 
requirements to enter active duty under the prior service 
program because he did not have at least 24 months of total 
active federal military service. In accordance with AFI 36-
2002, Regular Air Force and Special Category Accessions, the 
enlistment grade for NPS enlistees is E-1 and the date of rank 
is the date they enlisted into the Regular Air Force. If the 
enlistee has over 90 days active duty service and last served in 
pay grade E-2 or higher, or is a Service Academy ex-cadet with 
over 90 days service, then the grade is E-2. Although the 
applicant did serve at least 90 days on active duty service, he 
was not promoted to E-2 during his initial enlistment, nor did 


he meet the requirements to be considered a Service Academy ex-
cadet.

APPLICANT'S REVIEW OF THE AIR FORCE EVALUATION: 

 

On 23 Oct 2012, a copy of the Air Force evaluation was forwarded 
to the applicant for review and comment within 30 days. As of 
this date, no response has been received by this office (Exhibit 
D).

THE BOARD CONCLUDES THAT: 

 

1. The applicant has exhausted all remedies provided by 
existing law or regulations. 

 

2. The application was not timely filed; however, it is in the 
interest of justice to excuse the failure to timely file. 

 

3. Insufficient relevant evidence has been presented to 
demonstrate the existence of error or injustice. We took notice 
of the applicant's complete submission in judging the merits of 
the case; however, we agree with the opinion and recommendation 
of the Air Force office of primary responsibility and adopt its 
rationale as the basis for our conclusion the applicant has not 
been the victim of an error or injustice. Therefore, in the 
absence of evidence to the contrary, we find no basis to 
recommend granting the relief sought in this application.

THE BOARD DETERMINES THAT: 

 

The applicant be notified that the evidence presented did not 
demonstrate the existence of material error or injustice; that 
the application was denied without a personal appearance; and 
that the application will only be reconsidered upon the 
submission of newly discovered relevant evidence not considered 
with this application.
